Scope of Professional Engagement
Smart IT Digital provides enterprise-grade consulting and technical execution services including, but not limited to:
Cloud Strategy and Rationalization:
Evaluation, planning, and structured migration of enterprise workloads to public, private, or hybrid cloud environments.
Architectural Modernization:
Transformation of legacy systems into cloud-native, containerized, and AI-ready architectures.
Governance and Compliance:
Alignment of cloud environments with regulatory and security standards including GDPR, DORA, SOC2, and other applicable frameworks.
The specific scope of work for each engagement shall be defined in a mutually executed Service Agreement or Statement of Work (SOW).
Acceptable Use and Conduct
Our Services are intended strictly for lawful, professional, and enterprise transformation purposes.
- You agree not to:
- Use our Services for any unlawful activity or violation of international data protection regulations.
- Reverse-engineer, replicate, or decompile proprietary migration frameworks or architectural templates
- Attempt to bypass cloud security controls or provider guardrails
- Conduct unauthorized stress testing, penetration testing, or infrastructure probing
- Use automated systems to scrape, extract, or reproduce our intellectual property
Client Responsibilities
A successful transformation engagement is a collaborative effort.
The Client agrees to:
Accuracy of Information
Provide complete, accurate, and up-to-date infrastructure data and metadata.
Licensing Compliance
Ensure all legacy software and workloads are properly licensed for cloud deployment.
Credential Security
Maintain strict control and confidentiality over administrative access credentials granted during the engagement.
Operational Cooperation
Provide timely feedback, approvals, and access necessary for project completion. Failure to meet these responsibilities may result in delays or additional service costs.
The Intellectual Property and Clean Core Philosophy
Smart IT Digital Property.All pre-existing methodologies, frameworks, migration scripts, architectural templates, and proprietary tools remain the exclusive property of Smart IT Digital.
Client Deliverables.Upon full payment of applicable fees, the Client is granted a perpetual, non-exclusive, non-transferable license to use deliverables created during the engagement strictly for internal business operations.
Open Source Components.Certain solutions may incorporate open-source technologies such as Terraform modules, Kubernetes frameworks, or other libraries governed by their respective licenses (e.g., MIT, Apache). Such components remain subject to their original licensing terms.
AI and Automated Orchestration
As of 2026, Smart IT Digital utilizes Autonomous Agents and AI-Assisted Code Generation to enhance efficiency and accelerate migration timelines.
- All AI-generated outputs are reviewed, validated, and approved by a Certified Human Architect prior to implementation.
- Client proprietary data will not be used to train public or third-party artificial intelligence models. We maintain strict internal governance over automated systems to ensure quality, compliance, and security.

Limitation of Liability and Shared Responsibility
Cloud computing operates under a Shared Responsibility Model.
- Smart IT Digital is not liable for outages, data loss, service interruptions, or security incidents caused by third-party Cloud Service Providers including AWS, Microsoft Azure, or Google Cloud.
- Our total liability shall be strictly limited to the professional fees paid for the specific phase of work in which the claim arises.
- Lost profits
- Indirect or consequential damages
- Business interruption losses
- Migration cutover-related downtime
